The Independent Communications Authority of South Africa (ICASA) intends to conduct an inquiry into how over-the-top (OTT) services affect licensed operators and the existing regulatory framework in South Africa.

Notice of Intention to Conduct a Market Inquiry into the impact of OTT services on licensees

According to the notice, the inquiry will consider the impact of OTT services across the telecommunications, broadcasting and postal services sectors, including their effect on licensees operating within these industries.

The inquiry is expected to proceed through the following phases:

• Phase 1 – Commencement
  • Publication of the notice above, together with a questionnaire on the ICASA website.
  • Deadline for submitting questions seeking clarification (+10 working days).
  • ICASA to respond to clarification questions through the publication of a briefing note (+10 working days).
  • Deadline for written submissions (+45 working days from the date of publication of the briefing note).
  • One-on-one meetings to be arranged where necessary.
• Phase 2 – Discussion Document
  • Deadline for written submissions (+45 working days).
• Phase 3 – Public Hearings
• Phase 4 – Findings Document
  • Publication of the findings document (+90 working days).
